Prehistoric Transylvanian mammal had blood-red teeth

SMALL, with oversized blood-red incisors, and down the road from Dracula's lair to boot. To coincide with Halloween, we bring you Barbatodon transylvanicus, a 70-million-year-old mammal that scurried beneath the feet of dinosaurs. The discovery of a new skull, complete with teeth, gives the first clues to its diet.

Barbatodon lived in what is now Transylvania, Romania, about 200 kilometres from the castle of the bloodthirsty medieval prince Vlad Dracula. It was roughly the size of a rat and belonged to a little-known group of mammals called multituberculates that outlived the dinosaurs, then died out 35 million years ago.

Thierry Smith of the Royal Belgian Institute of Natural Sciences in Brussels and Vlad Codrea of the University of Babes-Bolyai in Romania, who found the fossil, shown below, say that its red tooth enamel is 3 per cent iron, which probably made it more resistant to abrasion.

Smith presented the findings at the Society of Vertebrate Paleontology meeting in Raleigh, North Carolina, last month.

So what did the diminutive mammal eat? In the new fossil, its teeth look most like those of some modern-day shrews. That suggests it may have been partial to a meal of insects. Not so much bloodsucker, then, as insect crusher.

China's Baidu eyes soft fourth quarter as economy bites

SHANGHAI (Reuters) - Baidu Inc, China's largest search engine company, posted its slowest quarterly revenue growth in more than two years and forecast softer-than-expected growth this quarter, hurt by weaker sales as China's economic engine sputters.

However, the company -- which still grew revenue by 50 percent in the third quarter -- said it added a record number of new advertisers for the quarter and was focusing on boosting revenue from fast-growing mobile search traffic.

"Their large customers' spending has not been so robust and has been quite flat, but Baidu has done a decent job of bringing new customers online," said Michael Clendenin, managing director of technology consultancy firm RedTech Advisors.

Baidu has dominated China's search market since Google Inc relocated its search engine to Hong Kong in a row over censorship in 2010, and accounts for nearly 80 percent of all online searches.

It posted net income of $478.6 million in the three months ended September 30, up roughly 60 percent year-on-year. Baidu said it earned $1.39 per American Depository Share in the third quarter, excluding stock-based compensation expenses.

Revenue rose 49.7 percent to $994.6 million, and Baidu forecast fourth-quarter revenue of $979.3 million to $1.010 billion, below an average analysts' forecasts of $1.03 billion according to Thomson Reuters I/B/E/S, but up from $715.9 million a year ago.

Despite a slowdown in spending by its big advertising customers, Baidu said it added a record number of advertisers in the third quarter and now had a total 390,000 active online marketing customers.

Credit Suisse downgraded the company in October to "underperform" from "neutral", due to concerns about its ability to monetize its mobile search traffic and worries about the erosion of its search market dominance.

Baidu Chief Executive Robin Li said on Tuesday that the firm's PC search traffic was "not as exciting" as mobile search traffic, which was growing at triple digit rates.

"We are working hard to improve the monetization system for mobile and to educate our customers to take full advantage of mobile," Li told analysts on a phone hook-up.

"But we expect it would take some time to close the gap," he added, referring to both effective monetization and moving advertisers to mobile devices.

Baidu is also facing a challenge from China's top anti-virus software firm, Qihoo 360 Technology. A search engine launched by Qihoo in August has started to gain traction, accounting for 5-10 percent of search traffic since its launch, according to data from research firm Analysys International.

But analysts don't expect Qihoo to peel away much of Baidu's search market dominance because of the sheer size of the incumbent's resources.

"It's been one of these emotional hangovers on the (Baidu) stock but the reality is Qihoo is not monetizing and won't be monetizing probably until Q1 and even then it will be at a very small base," Clendenin said.

Baidu shares have fallen about 2 percent this year on expectations that it will be hurt by slower economic growth in China, underperforming a 14 percent rise on the Nasdaq exchange.

How are you all doing? Glad you all liked the Pinterested-themed Halloween dinner.

I am peachy.

p.s. Prayers to those on the east coast (and all over the world) who might be suffering from weather-related damages & inconveniences.

Yesterday was kind of exhausting, actually. Not going to lie there. And today, I am up even earlier than yesterday! But that?s okay. I am oddly up & fine at 5 a.m. I think I was born to run around/work out in the morning.

Anyone else just loooovveee working out in the morning?!? :)

Eat and Train for More Muscle

So I read a fun, short piece on building muscle, and thought I?d share it with you-including my thoughts and favs.

{Check out that?great article I found.}

Some of my favorites from the top 10 tips to build muscle include:

#10: Don?t get caught up in the latest fads. The fact is, weight training is the most efficient tool to change your body.

#9: Train your small muscles like the rotators in your shoulders, and make sure you keep your flexibility. You need your body to function as a unit to pack on more muscle. If you skip training smaller muscles, you?re likely to get stuck at plateaus more often.

#7: Eat. After your workout is done you have one task: to eat.

#1: Learn to enjoy training heavy. It?s not supposed to feel nice. If it?s not a little uncomfortable you probably have way more to give.

Very much agreed indeed.

First of all, AMEN. Enough with the fads and fad diets already! I try not to judge, but I am human. So seriously, why do people even follow fad diets anymore?! It drives me bonkers. Cutting out a food group (unless advised by a doc or for religious/personal reasons) has never been a good idea. Ever. And what?s more? There is not enough long-term evidence to prove that a fad diet will be healthy.

Remember, people back in the early/mid 1900?s thought smoking was a good idea-it looked cool, seemed harmless, and made it feel fun.

Yah. Exxxacctttlllyy.

A certain fad diet that might ?work? for a few people does NOT equal healthy or good for us in the long run.

Just sayin.?

Secondly, weight training changes your body. (For the better!)

Don?t need to expound on that.

Thirdly, try to hit all the major & minor muscle groups when you train! Love this tip.

I think that?s why I love teaching BP and doing my own thing. I can hit places and exercises I might not get from BP. BP does a great job of delivering an all-around total-body workout, but it?s always nice to throw in new-to-me exercises in the mix for my ?non? teaching day.

And lastly, if you want to build muscle, you MUST eat more-of everything, and especially in the way of healthy, lean protein.

Because I like to lift weights (and lift ?em heavy!), and I want to build muscle, it is key that I fuel & refuel often, that I eat enough, and that I help the rebuilding process once the workout is over.

Here are some things I have had to come to terms/started doing with as I?ve gotten stronger/built muscle:

  • it is no longer about the scale or how much I weigh (it def was during ED & disordered eating time)
  • I don?t care about calories, really (I never count them)
  • I prefer to check out the healthy fats, protein, and sugar grams when reading labels
  • when making meals or snacks, I first decide where my protein and veggies will come in to play, then I add my complex carb & healthy fat
  • I prefer to measure how I?m doing with pants fitting and how I feel rather than a number dictating my worth/weight <?often we get those mixed up, ladies!
  • I actually like looking at pictures of myself again (during my disordered eating & ED days, I always hated pics of me). Now I like looking strong!
  • I wear pants again that I haven?t in a long time. Thank you muscles!

If you want to change your body, you had better lift (heavy/heavier) weights, eat up!, and forget the scale.

p.s. I probably weigh about the same that I did when I was in H.S., but I wear 1-2 pant sizes smaller now.

Muscle takes up less space than fat.

BMO: Boomers warned housing-based retirement ... - Financial Post

About a third of Baby Boomers plan to sell their home to fund their retirement, according to a study that questions whether buyers will dry up as that massive segment of the population downsizes.

Bank of Montreal is warning Boomers not to count on that nest egg, while other observers suggest that even if prices don?t plunge, big increases in property values are a thing of the past.

?They shouldn?t be relying on their homes because there are risks,? says Marlena Pospiech, a retirement strategist at the BMO Retirement Institute.

The bank suggests the following risky scenario: As Canada?s population ages, more Boomers will be retiring and selling their homes, putting downward pressure on prices.

[Boomers] could be in serious financial trouble if they are relying on their home, especially if they are highly leveraged

BMO also says tighter lending standards and higher interest rates could reduce the number of eligible homebuyers and push people into smaller and less expensive homes.

The bank?s survey suggests 34% of homeowners are unsure if they will sell their home before retirement. The concern seems to be that 40% of respondents say they are not confident in their ability to save for retirement and 41% say they might just end up using their homes to shore up any shortfall in their golden years.

?You want to have options when you retire, you don?t want to feel you are forced to sell to tap into any equity,? says Ms. Pospiech, adding the problem is compounded if prices fall. ?[Boomers] could be in serious financial trouble if they are relying on their home, especially if they are highly leveraged.?

Don Lawby, chief executive of Century 21 Canada, has heard warnings about a lack of buyers for Boomer homes before. ?I don?t buy it; I think it?s just talk,? he says.

For starters, he says, there is little indication immigration is going to slow and, increasingly in places like the Vancouver area, where he resides, immigrants have more money to buy the single-family homes of the Boomers.

?I think single-family detached are becoming a bit of a luxury,? says Mr. Lawby. But he says even townhouses and condos will continue to rise in price because of rising land costs. ?They are not making any more land.?

He says prices in big cities, in particular, will continue to rise and increase equity that could some day fund a retirement.

?If I had wonderful single-family home in [a small town], I can?t retire on the increased value, but in major cities I think they are just wrong.?

That might sound like the usual realtor?s optimism, but demographers say a collapse in prices based on Boomer homes flooding the market isn?t reality either.

?There is going to be continuing demand for housing as long as we bring in 250,000 immigrants a year,? says Doug Norris, chief demographer at Environics Analytics.

Given the creation of about 175,000 households each year (based on the latest census data), that?s plenty of demand.

Boomers are also living longer and may not downsize as quickly as they have in the past.

?There is just no strong evidence of what will happen,? says Mr. Norris.

Demographer David Foot, author of Boom, Bust and Echo, believes there are enough children of Boomers to soak up the housing supply.

?The Boomers have been averaging about two kids per family [in the U.S.] and replacing themselves,? says Mr. Foot. ?It?s a bigger issue in Canada because the Boomers only had about 1.6 or 1.7 kids per family. The echo isn?t quite as big.?

He predicts the twentysomethings today that have been driving the condo market will at some point buy into single-family detached homes.

?There are enough of them to buy the Boomers? houses.?

His more pressing worry is for the condominium segment.

?It is question of whether they will move out to the suburbs to raise their kids like every other generation has,? says Mr. Foot. ?My concern is who will buy all the condos when the twentysomethings vacant them.?

Funeral plans announced for Catawba teens who died in wreck ...

The families of two Catawba County teens who died after driving off a bridge on a trip to Myrtle Beach have planned joint memorial services this Saturday in Mooresville.

Jake Ziegler, 18, and Ray Pierce, 17, seniors at Bandys High School in Catawba County, left a party in the early hours of Oct. 13. They told friends they were going to take Ziegler?s 2006 Pontiac G6 to Myrtle Beach, about four hours away, to watch the sunrise.

When they didn?t return, authorities and families began searching ? retracing the teens? path to the beach, handing out fliers at the Carolina Panthers game, even renting a helicopter to search for the green car.

The car and the boys? bodies were discovered in marshy water off Interstate 20, just east of Columbia.

A Memorial service for the teens will be held at 2 p.m. on Saturday, November 3 at Cavin-Cook Funeral Home Chapel in Mooresville. The family will receive visitors following the service.

Pierce?s family is also holding a funeral Mass at noon on Friday, at Holy Spirit Catholic Church.

In lieu of flowers, the teens? families encourage people to make memorials to Community United Effort (C.U.E.) Center for Missing Persons, which assisted in the two-week search for the Ziegler and Ray. The center?s mailing address is: P.O. Box 12714, Wilmington, North Carolina 28405.

Romney scraps Monday night and Tuesday campaigning

AVON LAKE, Ohio (AP) ? Republican presidential candidate Mitt Romney is curtailing his campaign schedule as Hurricane Sandy bears down on the Eastern seaboard, canceling planned appearances Monday night and all day Tuesday.

Campaign officials say vice presidential running mate Paul Ryan will also scrap campaign rallies during the same time frame.

The decision was announced a short while after President Barack Obama canceled a planned rally in Florida to fly back to Washington, where aides said he would oversee the government's response to the threat posed by the storm.

Romney intends to go ahead with speeches today in Ohio and Iowa before he begins observing his self-imposed storm-related moratorium on campaigning.

The former Massachusetts governor and Obama are locked in a close race, eight days before Election Day.

Apparent insider attack kills 2 NATO troops

KABUL, Afghanistan (AP) ? A man wearing an Afghan police uniform killed two NATO troops in southern Afghanistan on Tuesday, the international military alliance said.

The assault appeared to the be the latest in a string of insider attacks that have threatened to sever the partnership between international troops and the Afghan forces they are trying to train to take over responsibility for the country's security. There have also been cases of insurgents donning Afghan uniforms in assaults.

A statement from NATO gave no further details, saying the shooting is still under investigation.

Afghan officials said there was an attack in Helmand province's Nahri Sarraj district but also could not confirm any details.

"We know that there are casualties," said Ismail Hotak, the director of the provincial office that coordinates with the international forces.

Both the British and American militaries have large contingents in Helmand.

At least 53 international troops have been killed in attacks by Afghan soldiers or police this year, and a number of other assaults are still under investigation, the international alliance has said.

The surge in insider attacks is throwing doubt on the capability of the Afghan security forces to take over from international troops ahead of a planned handover to the Afghans in 2014. It has further undermined public support for the 11-year war in NATO countries.

The attacks have not been limited to members of the NATO-led international coalition. More than 50 Afghan members of the government's security forces also have died this in attacks by their own colleagues.

Why would you want to do that to yourself anyway?

Beauty is pain, and these invasive procedures are rather painful. It does pay you in the long run as a professional dancer to have your boobs done if they need extra size. But please don?t ruin perfectly great boobs if you already have them, just to be bigger!

Make sure your chosen surgeon has current membership in these groups.? These are the four credentials you are looking for:

1.? American Society of Plastic Surgeons
2.? American Society for Aesthetic Plastic Surgery
3.? The American Medical Association
4.? Any Other Local associations for medicine and plastic surgery

There are many health care providers who perform plastic surgery procedures, but you need to be aware that they are not necessarily certified plastic surgeons. Only ASPS Member Surgeons are truly qualified to perform cosmetic and reconstructive surgeries of any kind.

American Society of Plastic Surgeons (ASPS) member surgeons have been fully certified by the American Board of Plastic Surgery (ABPS), or by the Royal College of Physicians and Surgeons in Canada. The ABPS is approved to certify plastic surgeons for practice by the American Board of Medical Specialties (ABMS), in particular for surgery to the face, but for other areas of the body as well.

Choosing an ASPS Member Surgeon means that your surgeon will:

1.? Have at least 6 years of training and experience in general surgery, with 3 years specifically in plastic surgery.

2.? Be certified by the American Board of Plastic Surgery

3.? Perform surgeries only in accredited medical facilities

4.? Adhere to a stringent code of ethics

5.? Complete all continuing education requirements, including patient safety techniques

6.? Be your partner and work with you personally to help you best achieve your goals

Don?t be shy about asking for verification from your potential surgeon regarding his credentials. Not only is this an appropriate question, but it is expected. It is also a good idea to ask your surgeon those tough, embarrassing questions that you really need to know; believe me, he or she has heard them before and will be happy to put your mind at ease.

A good surgeon wants to know you are involved in your own procedure and will be and active partner toward achieving your best possible results, and to your greatest satisfaction. After all, this is all about you ? this is your body and your business, so it warrants your serious consideration.

The American Society for Aesthetic Plastic Surgery maintains a helpful website with current information to help you locate a surgeon near you. Understand that there are no guarantees that all of these surgeons? work will be good, or that they will be right for you.

You will have to do your research and decide for yourself from what you discover and learn, and the surgeons you interview, and accept that this process will take time to do properly.

My advice, then, is to go forward with your exotic dancing career while you generate funds for your procedure and do your research. Be Patient! Wait a while. I promise you will have enough money and more in reserve to get the best results possible from the top doctor in Beverly Hills if you follow this advice!

Although it may not be necessary, I would recommend going to a large city where the medical community is competitive. Unless you know otherwise for certain, stay away from smaller towns. Cities with great surgeons include Los Angeles, Miami, Houston, Jacksonville, and other cities this size or larger.

The reason is very simple, it's called MUTATION. Yes, viruses mutate, even the engineered ones. That targeting mechanism is either going to cease to function, get bypassed, or widen it's range of targets, and there is no way to predict which it will do or when it will happen.
Here's another thing to think about. Without including a massive amount of targeting info in the virus, you won't be able to discern between related targets or just random individuals with similar dna. Because of that, you will be unintentionally targeting unwanted subjects. If that's not bad enough, if you really do put in enough info for the virus to target 1 individual in the human populace, that huge amount of info is going to be a drain on the resources of the virus. You know what many microbes like to do with massive useless genes like that? They throw them away. Yes, that's right, it might not even take one replication in release before they chuck all your precious targeting info. And then what happens? Do they no longer have their deadly payload, or do they use it on everyone?

So leave this stuff to sci-fi writers, because reality is that viruses make HORRIBLE targeted weapons, though they aren't bad for indiscriminant killing and terror, even if they are a lot slower than bombs, guns, knives, poisons, and all other weapons in existence.

Exercise makes middle-aged people smarter

ScienceDaily (Oct. 29, 2012) ? High-intensity interval training makes middle-aged people not only healthier but smarter, showed a Montreal Heart Institute (MHI) study led by Dr. Anil Nigam of the MHI and University of Montreal, in collaboration with the Montreal Geriatric University Institute.

The participants all had a body-mass index (BMI) between 28 and 31 (overweight) in addition to one or more other cardiovascular risk factors. Body-mass index is calculated as a person's weight divided by their height squared (kg/m2) -- 25 to 30 is considered overweight, over 30 is obese. High-intensity interval training involves alternating between short periods of low and high intensity aerobic exercise -- for example, a series of 30 seconds of sprinting followed by 30 seconds of walking or jogging.

"We worked with six adults who all followed a four-month program of twice weekly interval training on stationary bicycles and twice weekly resistance training. Cognitive function, VO2max and brain oxygenation during exercise testing revealed that the participants' cognitive functions had greatly improved thanks to the exercise," Dr. Nigam said. VO2max is the maximum capacity of an individual's body to transport and use oxygen during exercise. It impacts on the body's ability to oxygenate the brain and is related to cognitive function.

"Our participants underwent a battery of cognitive, biological and physiological tests before the program began in order to determine their cognitive functions, body composition, cardiovascular risk, brain oxygenation during exercise and maximal aerobic capacity," Dr. Nigam explained. The cognitive tests included tasks such as remembering pairs of numbers and symbols. To see what was actually happening in the brain, the researchers used near-infra red spectroscopy (NIRS), a technique that works with light (in the near-infra red range) sent though human tissue that reacts with oxygen in the blood (light absorption). It is so sensitive that it detects the minute changes in the volume and oxygenation of blood occur in our brains when we exercise or think.

"After the program was finished, we discovered that their waist circumference and particularly their trunk fat mass had decreased. We also found that their VO2max, insulin sensitivity had increased significantly, in tandem with their score on the cognitive tests and the oxygenation signals in the brain during exercise," Dr Nigam said. Insulin sensitivity is the ability of sugar to enter body tissue (mainly liver and muscle.)

The scientists believe that many people could benefit by following a similar training program to the one used in their study, and they will be presenting their findings at the Canadian Cardiovascular Congress (CCC) in Toronto in October 27-31, 2012. The research was financed by the ?PIC Centre and Montreal Heart Institute Foundations.

Atrial fibrillation is a 'modifiable' risk factor for stroke

ScienceDaily (Oct. 28, 2012) ? There is good evidence that people with an irregular heart beat should have it checked by a doctor. The link between atrial fibrillation -- the most common disturbance of heart rhythm -- and risk of stroke is now beyond dispute, with studies indicating that diagnosed atrial fibrillation (AF) increases the risk of stroke five times. Similarly, one in five patients diagnosed with stroke are also found to have AF.

Atrial fibrillation, whose prevalence continues to rise, was described last year as the "new epidemic" in cardiovascular disease, even though AF can be successfully controlled by the detection and management of risk factors, by rhythm control treatments, and by the use of antithrombotic therapies.(1) These therapies have been improved in the past few years by the introduction of new anticoagulant drugs, such that AF -- like high blood pressure or smoking -- may now be considered a "modifiable" risk factor for stroke, whose treatment can reduce the degree of risk.

Professor Freek Verheugt, from the Onze Lieve Vrouwe Gasthuis in Amsterdam and speaking on behalf of the European Society of Cardiology (ESC), says: "All individuals with irregular heart beat should see a doctor, who can diagnose whether this heart rhythm disorder is likely to lead to stroke. If so, blood thinning medication can reduce the risk of stroke by up to 70%."

The latest ESC Clinical Practice Guidelines on Cardiovascular Disease Prevention, which were revised this year, describe stroke as the "second major cardiovascular disease" (after coronary heart disease) and, like CHD, with enormous scope for prevention.(2) Indeed, more than 50% of the reductions seen in heart disease mortality over recent decades relate to changes in risk factors. In addition, the treatments prescribed to lower blood pressure, for example, also reduce the risk of stroke, such that stroke prevention is still the most evident effect of antihypertensive treatment.

The Interstroke study, which was reported in 2010 following an analysis of stroke data from 22 countries, indicates that just ten risk factors are associated with 90% of total stroke risk.(3) The highest attributable effect of individual risk factors was 35% from hypertension, 26.5% for waist-to-hip ratio, and 19% for current smoking.(3)

The ESC emphasises that most of these risks for stroke are also the same major risks for coronary heart disease -- high blood pressure, smoking, obesity, lack of exercise and excessive alcohol consumption. In addition, AF, this common disorder of heart rhythm, is also clearly associated with an increased risk of stroke. Indeed, the very latest ESC guidelines on AF, published in August, state: "Diagnosing AF before the first complications occur is a recognized priority for the prevention of strokes," and that "even short episodes of 'silent' AF convey an increased risk for stroke." (4)

While the guidelines advise that the evidence in favour of aspirin in stroke prevention is "weak," they add that a new range of anticoagulant drugs are "broadly preferable" for stroke prevention in AF, but, because experience remains limited, they are recommended within the context of "strict adherence to approved indications." The guidelines state that these novel anticoagulants "offer efficacy, safety, and convenience" compared with previous therapies.

Professor Verheugt emphasises that stroke is not an inevitable consequence of aging and that, by identifying and modifying risk factors, there are substantial opportunities to reduce stroke risk -- through lifestyle interventions and the control of high blood pressure and AF.

I don?t use it because it doesn?t handle emails, webpages, voice memos or pictures, and it requires internet access.

Some of my best ideas come when I don?t have internet access, such as on an airplane. Evernote is there for me when WorkFlowy isn?t.

Others simply use a physical piece of paper and a pen. If your smartphone and laptop are drained of power, it?s your only option! But usually our smartphones are at our side at all times whereas a legal pad and pen may not.

Become a Collector

The most successful people in any endeavor are collectors. Collectors of ideas, techniques, lessons, facts, tips, and experiences. If you aren?t already, become a real estate investing collector. Over time, you?ll be shocked at your progress. So few people do it that when you begin to collect ideas in an organized fashion, you will be in a league all of your own.

(AP) ? Two black men wrongly convicted in the 1977 murder of a white Iowa police officer hope to prove something they couldn't during trials that sent them to prison for 25 years: that detectives framed them to solve a high-profile case.

During a civil trial that starts Wednesday in Des Moines, Terry Harrington and Curtis McGhee will argue that Council Bluffs police officers coerced witnesses into fabricating testimony against them in the killing of John Schweer.

Schweer was found dead while working as the night watchman at a car dealership. Harrington and McGhee, then teenagers from neighboring Omaha, Neb., say detectives used threats against a group of young black car theft suspects to trump up evidence targeting them because of their race and pressure to solve the retired captain's killing.

Despite little physical evidence, Harrington and McGhee were convicted at 1978 trials and sentenced to long prison terms. They were freed in 2003, after the Iowa Supreme Court found that prosecutors committed misconduct in concealing reports about another man seen near the crime scene with a shotgun. The key witnesses had also recanted their testimony, saying they were pressured into implicating the men.

After winning their freedom, they filed lawsuits against prosecutors and officers they blamed for forcing them to spend their adult lives in the Fort Madison prison. Their case reached the U.S. Supreme Court in 2009 over the issue of whether suspects have the constitutional right not to be framed by prosecutors. Before justices ruled, Pottawatamie County agreed to pay $12 million to settle claims against two former prosecutors while not admitting wrongdoing.

The settlement did not resolve claims against Council Bluffs and former detectives Dan Larsen and Lyle Brown.

Harrington and McGhee claim Larsen and Brown coerced the group of black car theft suspects into fingering them in the death. Investigators took the star witness, a 16-year-old confessed liar with numerous aliases, to the crime scene, gave him details about the murder weapon, and had him repeatedly change his story until it was plausible, the lawsuit claims.

The witness, Kevin Hughes, was aggressively questioned in Schweer's death after he was pulled over several weeks later driving a vehicle stolen from a Nebraska dealership. He first implicated three other men who had alibis before eventually claiming Harrington pulled the trigger and McGhee drove the getaway car after they went to steal a car from the dealership Schweer was guarding. Hughes said later he lied to get reward money and avoid being charged himself. Other witnesses also recanted.

Jurors will be asked to decide at trial, scheduled to last through Nov. 16, whether detectives, who were both white, and the city violated Harrington and McGhee's civil rights and, if so, how much they should receive in damages.

"We have waited for a very long time to have this trial and we look forward to having an opportunity to present our case," said Stephen Davis, an attorney for McGhee, now married and living in a Midwestern community he does not want to disclosure.

Facing a possible verdict of millions, lawyers for the detectives and the city are making an aggressive defense. They plan to argue that Harrington and McGhee probably were the real killers ? and that even if they weren't, detectives did nothing wrong in focusing on them as suspects under the circumstances.

"There is going to be evidence that this civil jury will hear surrounding Terry Harrington and Curtis McGhee's involvement in this crime and it's evidence that the juries in 1978 considered," said attorney Kristopher Madsen. "But importantly, we believe there's going to be lacking any credible evidence to indicate these two police detectives in any way fabricated evidence or coerced or threatened witnesses or violated any civil rights of Harrington and McGhee."

The stakes are high for the city because recent court rulings have concluded it will have little insurance coverage if liable.

Lawyers would not say how much compensation Harrington and McGhee would seek, but they plan to show jurors a mock prison cell to illustrate their lives behind bars. Harrington's daughter, born after he was imprisoned, is expected to testify about the former high school football player's long dream of freedom.

A key question will be why detectives stopped pursuing suspect Charles Gates. Police reports about Gates had been hidden from the defense and were uncovered in 1999 by a former prison barber who became convinced of Harrington's innocence and worked for years for his freedom.

They showed that witnesses reported seeing a man with a dog carrying a shotgun near the crime scene, where Schweer's bullet-riddled body was found surrounded by bloody dog prints. In the nights before his death, the police reports show Schweer reported having altercations with a white man carrying a shotgun and walking a dog ? something Gates was known to do.

Police questioned Gates, a 48-year-old loner, and he failed a lie-detector test. He had also been a suspect in an earlier unsolved murder. Investigators even consulted an astrologer about Gates, but ignored him after Hughes and other teens were stopped in the stolen car. Gates denied in a 2003 interview with police that he was involved in the slaying. Attempts to find Gates and reach him for comment were not successful.

"Larsen and Brown thought it was their lucky day. They could pin the murder on them, or use them to pin it on some 'ghetto dwellers'," plaintiffs' lawyers wrote, using a term detective Larsen once used to refer to Omaha residents. "Either way, Larsen and Brown would be putting blacks in front of a white Council Bluffs jury for the killing of a white Council Bluffs cop. That would mean case closed and they would be heroes."

Tsunami warning in Hawaii downgraded to advisory

HONOLULU (AP) ? A Hawaii tsunami warning that spurred coastal evacuations statewide was downgraded to a tsunami advisory early Sunday, ending the threat of serious damage less than three hours after the first waves hit the islands.

Hawaii Gov. Neil Abercrombie said early Sunday that the Aloha State was lucky to avoid more severe surges after a powerful earthquake struck off the coast of Canada.

Abercrombie said beaches and harbors are still closed statewide.

"We're very, very grateful that we can go home tonight counting our blessings," Abercrombie said.

Meanwhile, the National Weather Service canceled tsunami advisories for Canada and Oregon, leaving northern California as the only spot in North America still under a tsunami advisory.

The first waves hitting Hawaii on Saturday night were smaller than expected.

Gerard Fryer, a geologist tracking the tsunami for the Pacific Tsunami Warning Center, said the largest wave in the first 45 minutes of the tsunami was measured in Maui at more than 5 feet, about 2 feet higher than normal sea levels.

No major damage was reported.

At first, officials said Hawaii wasn't in any danger of a tsunami after the 7.7-magnitude earthquake rattled the western coast of North America Saturday night, sparking tsunami warnings for southern Alaska and western Canada.

Later, officials issued a warning for Hawaii as well, saying there had been a change in sea readings. About the same time, a tsunami advisory was issued for a 450-mile stretch of U.S. coast running from north of San Francisco to central Oregon.

A small tsunami created by the quake was barely noticeable in Craig, Alaska, where the first wave or surge was recorded Saturday night.

Fryer said it could take several hours for the danger to pass in Hawaii, especially if the waves get bigger.

"It's beginning to look like the evacuation may not have been necessary," Fryer said.

The National Weather Service said there were reports of water quickly receding in bays, including Hilo Bay on the Big Island.

The warning in Hawaii spurred residents to stock up on essentials at gas stations and grocery stores and sent tourists in beachside hotels to higher floors in their buildings. Bus service into Waikiki was cut off an hour before the first waves, and police in downtown Honolulu shut down a Halloween block party.

Abercrombie proclaimed an emergency, mobilizing extra safety measures.

While television traffic cameras showed onlookers at the beach in Waikiki, Honolulu Mayor Peter Carlisle warned people to stay away from the surf for several days.

Carlisle ? who recommended people think about ditching their cars if they were in traffic ? said people should be cautious.

"There's no reason to panic but there's every reason to take all of the necessary precautions," he said.

Coast Guard officials closed all harbors in the state to incoming boats and urged vessels to leave and not return until an all-clear is given.

"We don't have any reports of any tsunami impacts at this time, but we caution mariners because the tsunami surges can continue for several hours," Chief Warrant Officer Gene Maestas said.

In Kauai, three schools used as evacuation centers quickly filled to capacity.

As many people along Hawaii's coasts rushed to higher ground, officials downgraded a tsunami warning to an advisory for southern Alaska and British Columbia. They also issued an advisory for areas of northern California and southern Oregon.

In Alaska, the wave or surge was recorded at 4 inches, much smaller than forecast, said Jeremy Zidek, a spokesman for the Alaska Department of Homeland Security and Emergency Management.

The U.S. Geological Survey said the earthquake hit in the Queen Charlotte Islands area. The quake was felt in Craig and other southeast Alaska communities, but Zidek said there were no immediate reports of damage.

The West Coast and Alaska Tsunami Warning Center issued a warning for coastal areas of southeast Alaska, down the western Canadian coast to the tip of Vancouver Island.

Later Saturday evening, the warning for those areas was downgraded to an advisory, while a warning was issued for Hawaii.

In addition, officials issued an advisory for areas from Gualala Point, Calif., about 80 miles northwest of San Francisco, to the Douglas-Lane county line in Oregon, about 10 miles southwest of Florence.

The Del Norte County Sheriff's Department, based in Crescent City, Calif., near the Oregon line, said it hadn't heard of any problems as a result of the tsunami. Crescent City was one of the U.S. towns hit hardest by last year's tsunami from the Japan quake, with boats in the harbor suffering serious damage.

By early Sunday morning, all warnings and advisories for coastal areas of North American had been canceled, except for a stretch of California coast beginning 80 miles north of San Francisco and stretching to the Oregon line, which remained under an advisory.

A tsunami warning means an area is likely to be hit by a wave, while an advisory means there may be strong currents, but that widespread inundation is not expected to occur.

Fryer said it's not surprising that an earthquake so far away could generate dangerous waves in Hawaii.

"There is nothing between Canada and us that would scatter the energy, so once the beam is formed, it just points right at us," Fryer said.

The U.S. Coast Guard in Alaska said it was warning warn everyone with a boat on the water to prepare for a potential tsunami.

The first wave hit Craig about two hours after the earthquake.

"It started off where it might be a 3-foot wave, and it kept getting downgraded," Craig Mayor Dennis Watson said. "And the last time we heard, it was less than 1 foot."

It actually was recorded at 4 inches. Watson said he was downtown on the waterfront, and had his car lights shining on pylons.

"I didn't even see the surge. I watched the pylons. And the tides came in about four or five inches. The surge would leave a wet spot as it would go back out, and we never did see that," he said.

There could be subsequent waves in Craig, but an official with the tsunami warning center didn't think it would amount to much.

The first wave "typically is not the largest but nevertheless we don't expect the maximum wave height to be large," said Bill Knight.

The state Department of Homeland Security and Emergency Management activated its emergency operations center and notified officials in southeast Alaska communities.

Lt. Bernard Auth of the Juneau Command Center said the Coast Guard was also working with local authorities to alert people in coastal towns to take precautions.

Lucy Jones, a USGS seismologist, said the earthquake likely would not generate a large tsunami.

"This isn't that big of an earthquake on tsunami scales," she said. "The really big tsunamis are usually up in the high 8s and 9s."

She said the earthquake occurred along a "fairly long" fault - "a plate 200 kilometers long" in a subduction zone, where one plate slips underneath another. Such quakes lift the sea floor and tend to cause tsunamis, she said.

In Craig, officials implement an emergency plan, and took fire trucks, ambulances and heavy equipment to higher ground.

"If nothing else it was a good exercise in determining how well our disaster plan works. I thought it came off quite well, really," he said.

Watson said he did receive calls from townspeople about the tsunami.

"There's supposed to be a big Halloween party downtown. People are calling, 'Did the wave hit yet so we can go to the party?'" he said.
