Top EU court rules against 'live stream' web broadcaster... | Stuff.co.nz

Europe's highest court dealt a blow to companies that retransmit free-to-air television programming over the internet on Thursday, ruling that original broadcasters have the right to prohibit any such redistribution.

The case involves UK-based TVCatchup Ltd, which offers "live" streaming of free-to-air television shows, including programming by the BBC, ITV and Channel 4, Britain's three largest terrestrial broadcasters, and Sky.

TVCatchup is accessible only to subscribers with a valid British TV license who are in the United Kingdom, the same audience that could watch programs for free on terrestrial TV.

But the European Court of Justice ruled against TVCatchup, saying that under a 2001 EU law, original broadcasters are held to be "authors" with an exclusive right to authorise or prohibit any communication of their work to the public.

The ruling will be a boost to ITV, which brought the case, and to other domestic broadcasters whose potential audience is effectively being rerouted to a revenue-generating website -TVCatchup streams commercials before its programming.

"EU law seeks to establish a high level of protection for authors of works, allowing them to obtain an appropriate reward for the use of those works," the court said in a statement.

"Television broadcasters may prohibit the retransmission of their program by another company via the internet," it said.

"That retransmission constitutes, under certain conditions, a 'communication to the public' of works which must be authorised by their authors."

The court's ruling was based on two lines of argument, first that TVCatchup is involved in communicating content, and secondly that it is reaching a broad public.

Because the website delivers program using a "specific technical means different from that of the original communication", the court said the transmission was a communication requiring approval from the original authors.

And because TVCatchup and similar services make their programs available to anyone in Britain with a TV license, "the retransmission is aimed at an indeterminate number of potential recipients and implies a large number of people."

As a result, the court said the internet broadcaster was not adhering to the letter of the 2001 law, which deals with the harmonisation of copyright in the European Union.

Intellectual property lawyers welcomed the ruling.

"Copyright issues connected with internet streaming are always complex. However ... the decision appears sensible," said Rebecca Swindells of Field Fisher Waterhouse in London.

"It would concern many in the media industry if companies like TVC were allowed to intercept broadcast signals without authority and retransmit them for commercial purposes.

Tony Ballard, broadcast lawyer and partner at London law firm Harbottle & Lewis, said the ruling would strengthen the rights of authors but imposed limits on how much copyright proprietors can charge as royalties.

"(It balances) the owners' rights against those of users."

How to see Comet PanSTARRS at its peak

You'll be hearing a lot about Comet PanSTARRS, also known as C/2011 L4, now that it's become visible in the Northern Hemisphere?? but if you're not properly prepared, the experience can be underwhelming. You have to know where and when to look, and with what. Fortunately, there are lots of resources to draw upon.

First, some quick facts: Comet PanSTARRS is thought to come from the Oort Cloud on the solar system's edge, and is making its first round through the inner solar system. It was discovered in 2011 by the Pan-STARRS Telescope team, but it didn't attract wide attention until last year, when astronomers noticed a brightening trend that promised to produce a sight visible to the naked eye. The comet is expected to shine brighter than the stars of the Big Dipper (magnitude +2 to +1) over the weekend.


The challenge is that during this time of peak brightness, the comet will be visible quite low near the western horizon, just after sunset.

"Look too early and the sky will be too bright," NASA postdoctoral fellow Rachel Stevenson said in a?PanSTARRS preview provided by the Jet Propulsion Laboratory. "Look too late, the comet will be too low and obstructed by the horizon. This comet has a relatively small window."

The farther north you are, the closer to the horizon you'll have to look. Those aren't exactly ideal conditions, especially if you have an obstructed view to the west, or if there are clouds on the horizon, or if there's significant haze in the air. The best viewing spots should be at higher elevations, far from haze and the glare of city lights, where the skies can get as dark as possible as soon as possible after sunset.

Depending on your location in the Northern Hemisphere, you may not be able to get a good look at the comet until next week. But even if you miss seeing it on Thursday or Friday, it's worth checking out a variety of spots over the next few days to get ready for the peak experience on March 12 and 13. That's when Comet PanSTARRS is due to make a pretty appearance close to the crescent moon.

Although the comet has become visible to the naked eye, you'll want to pull out the binoculars to make out the comet's tail. You might notice two elements to the tail, pointing in slightly different directions: One element is made up of glowing ionized gas, while the other is made up of dust that reflects the light of the sun.

PanSTARRS is due to make its closest approach to the sun on Sunday, coming within 28 million miles (45 million kilometers). On each evening after that, the comet's position will be slightly more elevated from the horizon, and shift slightly to the north. It'll also become dimmer. By mid-April, the comet will no longer be visible to the naked eye, even under the best circumstances.

When PanSTARRS fades from the spotlight, don't put your binoculars back in the attic: Another starry messenger from the outer solar system, known as Comet ISON, is due to make its appearance in November. Some skywatchers have dubbed ISON the "Comet of the Century" because the most optimistic projections suggest it could shine as brightly as the full moon. It's way too early to make firm predictions, but it's a good bet that the comet-watching skills you develop while looking for PanSTARRS will come in handy when it's ISON's turn.

The Engadget Interview: EFF's Julie Samuels talks patents, podcasting and the SHIELD Act

We've heard it shouted from the mountaintops more times than we'd care to mention: the patent system is fundamentally broken. But that manner of righteous indignation can often fail to make an impression on those attempting to live their lives unaffected on the sidelines, as hardware behemoths level a seemingly endless string of suits based on often overly broad language. One's perspective shifts easily, however, when targets change and the defendants themselves are no longer aggressively litigious corporations with an arsenal of filing cabinets spilling over with intellectual property, as was the case when one company used a recently granted patent to go after a number of podcasting networks.

When we wanted to get to the bottom of this latest example in a long line of arguably questionable patent litigation, we phoned up Julie Samuels, a staff attorney at the Electronic Frontier Foundation who has also been designated the organization's Mark Cuban Chair to Eliminate Stupid Patents. Samuels has been fighting the battle against dangerously broad patents for some time now, recently traveling to DC to support passage of the SHIELD Act (Saving High-tech Innovators from Egregious Legal Disputes), a congressional bill that would impose heavy fines against so-called patent trolls.

We spoke to Samuels about supposed trolls, podcasts, SHIELD and how those with microphones can make their voices heard.

Human brain treats prosthetic devices as part of the body

Mar. 6, 2013 ? People with spinal cord injuries show strong association of wheelchairs as part of their body, not extension of immobile limbs.

The human brain can learn to treat relevant prosthetics as a substitute for a non-working body part, according to research published March 6 in the open access journal PLOS ONE by Mariella Pazzaglia and colleagues from Sapienza University and IRCCS Fondazione Santa Lucia of Rome in Italy, supported by the International Foundation for Research in Paraplegie.

The researchers found that wheelchair-bound study participants with spinal cord injuries perceived their body's edges as being plastic and flexible to include the wheelchair, independent of time since their injury or experience with using a wheelchair. Patients with lower spinal cord injuries who retained upper body movement showed a stronger association of the wheelchair with their body than those who had spinal cord impairments in the entire body.

According to the authors, this suggests that rather than being thought of only as an extension of the immobile limbs, the wheelchairs had become tangible, functional substitutes for the affected body part. As Pazzaglia explains, "The corporeal awareness of the tool emerges not merely as an extension of the body but as a substitute for, and part of, the functional self."

Previous studies have shown that people with prosthetic devices that extend or restore movement may make such tools part of their physical identity, but whether this integration was due to prolonged use or a result of altered sensory input was unclear. Based on the results of this study, the authors suggest that it may be the latter, as the brain appears to continuously update bodily signals to incorporate these tools into a sense of the body. The study concludes that this ability may have applications in rehabilitation of physically impaired people.

How dedicated are MMA fans? Check out how one couple incorporated it into their wedding

When Rebecca Dodell and Fernando Albiar started dating, she wasn't much of an MMA fan. But she fell for the sport as their relationship grew more serious. Now, she attends UFC events and cheers on fighters with her fiance. The pair was in attendance at UFC 157 in Anaheim.

So when it came time to send out save the dates for their summer wedding, they decided to honor their favorite sport. In the front of the card, Dodell has the championship belt and Albiar has the interim. On the back, she has both because she's united the belts.

"It is who we are. Some of our family does not get it and some don?t like it. But this is us and we will continue to advocate for MMA," Albiar said.
